Partially acceptable modification application fully refused – Lessons from the Court of Appeal
Australia: On 20 July 2026, the NSW Court of Appeal delivered judgment in Etherington v North Sydney Council [2026] NSWCA 137, addressing the scope of the power to modify a development consent under s 4.55(2) of the Environmental Planning and Assessment Act 1979 (NSW). The case is the latest in a series of decisions arising from the Etheringtons' attempts to modify a development consent for their waterfront dwelling at Cammeray. The Court of Appeal found that a consent authority and the Court on appeal is not obliged to approve a modification application in part even where some of the modifications sought are found to be acceptable. Planners should take this decision into account when advising on modification applications seeking multiple amendments.
