Because of the internet, personality rights are increasingly infringed across national borders. Thus, international private law is gaining in importance, whereas recently, deepfakes via artificial intelligence pose an existential threat for one’s identity. The law must adapt to these technological advances and provide legal certainty. However, the divergent and diffuse determination of the place of action and the place of injury of personality rights infringements under the German and European international private law provisions does not currently stand up to this challenge. In consequence, the matter must be viewed in a new light.

Persönlichkeitsrechtsverletzungen erfolgen insbesondere über das Internet immer häufiger grenzüberschreitend. Dadurch gewinnt das internationale Privatrecht zunehmend an Bedeutung, wobei jüngst vor allem deepfakes durch künstliche Intelligenz eine große Gefahr für Persönlichkeitsrechte darstellen. Das Recht muss sich den technologischen Entwicklungen anpassen und den neuartigen Gefahren mit Rechtssicherheit begegnen. Die divergente und diffuse Bestimmung von Handlungs- und Erfolgsort der Persönlichkeitsrechtsverletzungen im Deliktsstatut wird diesen Ansprüchen bis dato jedoch nicht gerecht und muss daher in neuem Lichte betrachtet werden.
