Administrative mechanisms cannot override mandatory statutory requirements
Tanzania: Labour disputes are governed by statutory frameworks designed to ensure predictability, legal certainty, and timely resolution. While administrative interventions and internal representations may appear attractive to aggrieved employees, such mechanisms cannot substitute or override express and mandatory statutory requirements established under the relevant legislation. The recent decision of the Court of Appeal of Tanzania in Civil Appeal No. 143 of 2022 between Geofrey Leonard Nyamwihula and Tanzania Social Action Fund (TASAF) [2026] TZCA 969 reinforces the principle that compliance with labour statutes prevails over informal administrative mechanisms. Parties cannot circumvent the mandatory statutory provisions by way of private arrangements, such as internal administrative procedures.
