On April 4, the U.S. Court of Appeals for the D.C. Circuit remanded an order issued by the Federal Energy Regulatory Commission (FERC) that dismissed a complaint filed by solar energy developer and Skadden client NextEra Desert Center Blythe, LLC.

Skadden secured the dismissal of a shareholder derivative suit brought against current and former members of the board of directors of Sempra Energy accusing them of breach of fiduciary duty based on a 2015 natural gas leak at a well located within Sempra subsidiary SoCalGas' Aliso Canyon underground storage facility.

Skadden achieved a favorable ruling on behalf of Barclays PLC in litigation with the Federal Energy Regulatory Commission (FERC), which filed a complaint in the U.S. District Court for the Eastern District of California charging Barclays and four former executives with manipulating the energy market, and had sought an approximately $500 million penalty from Barclays. FERC took the position that the action it filed against Barclays should not be governed by the Federal Rules of Civil Procedure and that no trial was necessary. Rather, FERC concluded that Barclays was liable based on its own investigation, in which Barclays had no ability to compel witnesses to testify or to produce documents.

Skadden secured a complete victory on behalf of Saoud Al-Mohannadi, vice president of the Qatar Football Association and Asian Football Confederation, defeating charges brought by the Investigatory Chamber of the FIFA Ethics Committee.

Skadden secured the dismissal of a putative class action against the University of North Carolina at Chapel Hill (UNC) brought by two former students who attended UNC on athletic scholarships and now allege the university breached its contract and duties with student-athletes because they purportedly were denied a high-quality education and directed to low-quality courses while attending the school.

Skadden won a motion to dismiss an amended putative securities class action complaint brought against clients El Pollo Loco Holdings, Inc. (EPL), Trimaran Capital Partners and other individual defendants.  

Skadden secured yet another dismissal in a series of similar class actions filed against client AXA Equitable Life Insurance Company. The putative class action alleged that AXA Equitable breached its contractual duties to variable annuity holders by implementing a volatility management strategy in certain investment portfolios. The complaint claimed that the company's purported omissions in regulatory filings with New York's Department of Financial Services breached certain terms of the plaintiff's variable annuity contract.
