Patent Term Extension in Australia: implications of <em>Otsuka v Sun Pharma</em> and changes in IP Australia practice
Australia: In December 2025, the Full Federal Court of Australia in Otsuka Pharmaceutical Co Ltd & Ors v Sun Pharma ANZ Pty Ltd confirmed that only patents with claims directed to an active pharmaceutical ingredient (API) per se are eligible for patent term extensions (PTEs). This decision reversed the previous position under which formulations are considered a “pharmaceutical substance” for PTE purposes. Otsuka has since applied for special leave to appeal to the High Court, with the application expected to be determined in March 2026.
