The Federal Court weighs in: the limits of set-off clauses and annualised salaries for award-covered employees determined
Australia: In a landmark decision, the Federal Court has clarified the lawful use of set-off clauses in employment contracts involving annualised salaries for award-covered employees.
In an amalgamation of joint proceedings involving Coles and Woolworths, the Court found that employers must not rely on “set-off” clauses within employment contracts to meet award entitlements – such as overtime and penalty rates. Rather, employers are obligated to ensure award entitlements are sufficiently met within each pay period. The decision also reinforces strict record-keeping obligations under the Fair Work Act 2009 (Cth), rejecting reliance on rosters and clock-in/out systems alone. This article explores the risks arising from the decision and outlines the practical steps your business should take to stay compliant and avoid costly underpayment claims.
