Limitless or limited: liability caps in construction contracts
United Kingdom: Whilst it is common for parties to negotiate clauses dealing with each party’s liability in construction contracts, we have recently experienced an influx of queries regarding the drafting of these clauses. During negotiations parties have concentrated mostly on the liability cap or limiting the exclusions, but some are finding themselves stuck when using ingenuity in the drafting of these clauses by falling foul of the interaction with other clauses of the contract, statutory limitations or duties and common law.
