Proportionate liability and the Building Amendment Bill 2026
New Zealand: Under the existing ‘joint and several liability’ regime, a claimant can recover the full cost of defective building work from any one liable party, regardless of that party’s relative contribution to the defect/claimed loss. This places the insolvency risk with the defendants; where there are parties which contributed to a loss that are not available to pay (e.g., through insolvency or death) then the liability falls to those defendants that are.
